14300.38 - Variances from the Recordkeeping Rule

Private employers can keep records in a different manner than prescribed by the new Cal/OSHA recordkeeping requirements if they:
Pruning
  • submit a variance petition to Federal OSHA and
  • can demonstrate that the alternative recordkeeping system:
  • collects the same required information.
  • meets the purposes of the Act. 
  • does not interfere with the administration of the Act.

Public employers can keep records in a different manner than prescribed by the new Cal/OSHA recordkeeping requirements if they write a letter to the Division of Labor Statistics and Research.
